Terms of Service

1. Acceptance

By using the Site, requesting an estimate, uploading a video walkthrough, or signing a document through the Site, you agree to these Terms of Service and to the Privacy Policy. If you do not agree, do not use the Site. Moving and storage services are governed by the Estimate Terms and Moving Services Agreement you receive with your quote and booking, which control over these Terms for those services.

2. Who may use the Site

You must be at least 18 years old and able to enter a binding contract. The Site is intended for people in the United States requesting moving or storage services in or from Minnesota.

3. Estimates and the video walkthrough

3.1 The Site lets you request an estimate by describing your move and, optionally, uploading a short video walkthrough of your home ("Walkthrough"), which automated tools analyze to draft an inventory and a preliminary estimate. 3.2 Any estimate shown or sent to you from the Site is preliminary and non-binding until a MileWay representative has reviewed and confirmed it in writing. Automated analysis can misidentify items, miss items that were not filmed, and misjudge size and weight, so MileWay does not guarantee the accuracy of a drafted inventory or price. 3.3 By uploading a Walkthrough you confirm that you are the occupant or have the occupant's permission, that anyone shown has agreed to be filmed, and that it contains nothing unlawful or that you have no right to share. 3.4 You grant MileWay a non-exclusive, royalty-free license to store, copy and process the Walkthrough and any photos you upload, including with automated tools run by our service providers, solely to prepare your estimate, perform your move, handle claims and improve our estimating. MileWay will not publish your Walkthrough or use it in advertising without your separate written consent. 3.5 MileWay Moving And Storage is a mover. We perform the moves we book with our own crews and trucks. We do not hand a booked move to another company without your written OK. A few items, such as slate pool tables, we do not move; for those we tell you up front and refer you to a specialist. 3.6 Our tariff, the schedule of every rate and charge we bill for a move, is kept at our office at 3731 Thurston Ave Suite 101, Anoka. As Minnesota law requires, you may look at it there, or ask us for a free copy by email at info@hiremileway.com. Your written estimate lists the charges that apply to your move.

4. Text Message Terms (SMS)

4.1 Program. MileWay Moving And Storage LLC runs one text message program, MileWay Moving Updates, for people who ask us for an estimate and for our customers.

4.2 How you opt in. Our estimate form has two optional, unchecked texting boxes. The first covers texts about your estimate and your move; the second, separate box covers marketing texts. Consent is not a condition of any purchase or service. If you tick only the first box, you get no marketing texts. If you text us first, we reply about that request only.

4.3 What we text. With the first box: your walkthrough link, your estimate, booking and deposit confirmations, reminders and crew updates, links to documents and payments, and replies to your messages. With the second box: follow-ups on an open quote, one review request after your move and occasional offers, up to 4 a month. With Text chosen for the free Digital Move Assistant & Utility Concierge (its own consent): its guide and up to 4 offers a month.

4.4 Frequency and cost. Message frequency varies. Message and data rates may apply.

4.5 Stop and help. Reply STOP to any text to opt out of every text; you receive one confirmation text and no further messages. Reply STOP MARKETING, or use the unsubscribe link in a marketing message, to end marketing texts only. Reply HELP for help, or call (612) 662-5609 or email info@hiremileway.com.

4.6 Carriers. Carriers are not liable for delayed or undelivered messages.

4.7 Privacy. We do not sell or share your SMS opt-in data or personal information with third parties for marketing purposes. See our Privacy Policy.

5. Acceptable use

Do not (a) upload malware or content that infringes anyone's rights; (b) scrape, crawl or reverse-engineer the Site or its estimating tools; (c) submit false information or requests on behalf of someone without their permission; (d) interfere with the Site's operation; or (e) use the Site for any unlawful purpose.

6. Intellectual property

The Site, its content and software, and the MileWay names and logos are owned by MileWay or its licensors. You may view and print pages for your personal, non-commercial use. All other rights are reserved.

7. Third-party services

The Site relies on third-party services (hosting, storage, automated estimating, messaging, maps, payments). MileWay is not responsible for their content or practices, and links to other websites are provided for convenience only.

Google Maps. When our forms suggest addresses as you type, the Site uses Google Maps features and content. Use of Google Maps features and content is subject to the then-current versions of the Google Maps/Google Earth Additional Terms of Service at maps.google.com/help/terms_maps and the Google Privacy Policy at policies.google.com/privacy.

8. Disclaimers

THE SITE, THE WALKTHROUGH TOOL AND ANY PRELIMINARY ESTIMATE ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. Nothing in this section limits the warranties and remedies that apply to moving and storage services under the Moving Services Agreement or that cannot be disclaimed under Minnesota law.

9. Limitation of liability

To the fullest extent permitted by law, MileWay and its owners, employees and service providers are not liable for any indirect, incidental, consequential, special or punitive damages arising out of your use of the Site, and MileWay's total liability arising out of the Site (as distinct from the moving or storage services) is limited to $100.

10. Indemnity

You will defend and indemnify MileWay against claims arising from your breach of these Terms, your Walkthrough or other content you upload, or your misuse of the Site.

11. Disputes; governing law

Minnesota law governs these Terms. Disputes arising out of the Site are subject to the dispute-resolution terms in the Moving Services Agreement, including individual arbitration, the small-claims option, and the 30-day opt-out, which are incorporated here. Venue for any court proceeding is Anoka County, Minnesota.

12. Changes; contact
